1. Acceptance of Terms
- These Terms of Service ("Terms") govern your access to and use of cardshowsnearby.com and related services (the "Service"), operated by Card Shows Nearby ("Card Shows Nearby," "we," "us," or "our").
- By accessing or using the Service, creating an account, or submitting a show, shop, or claim, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
- We may update these Terms from time to time as described in Section 15 below.
2. Eligibility
- You must be at least 13 years old to create an account or use the Service. If you are between 13 and 18 years old, you represent that you have your parent or guardian's permission to use the Service.
- You must provide accurate, current, and complete information when creating an account or submitting a listing, and keep that information up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3. Description of Service
- Card Shows Nearby is a directory and discovery platform for card show, trade night, and card shop listings across the United States. Browsing listings, creating a profile, saving shows, and submitting listings are currently offered free of charge.
- We do not process payments, sell tickets, or act as a party to any transaction between you and an event organizer, vendor, or shop. Any admission fees, table fees, or purchases you make in connection with a listed show or shop are solely between you and that organizer or shop.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
4. Show and Shop Submissions
- All show and shop submissions are reviewed before publication. We may edit, deny, or remove a listing at our sole discretion, including for inaccurate, misleading, incomplete, or inappropriate content.
- By submitting a show or shop listing, you represent that you have the right to list it, or are authorized to submit it on behalf of the organizer or shop, and that the information you provide is accurate to the best of your knowledge.
- Show details (dates, times, locations, pricing) are provided by organizers and are subject to change. We are not responsible for the accuracy of organizer-submitted information, and you should confirm event details directly with the organizer before attending.
5. Organizer and Shop Claims
- Claiming an organizer or shop profile is a representation that you are the legitimate operator of, or are authorized to manage, that organizer's shows or that shop's listing.
- We may request reasonable verification before approving a claim, and may deny or revoke a claim at our discretion, including if we later determine the claim was inaccurate, unauthorized, or made in bad faith.
- Approving a claim links all shows or shops publicly associated with that organizer or shop name to your account. You are responsible for the accuracy of listings under your claimed profile.
6. Acceptable Use
- You agree not to: post false, misleading, defamatory, abusive, harassing, discriminatory, or obscene content; impersonate another person or organization; share another person's private contact information without their consent; use the Service to spam, scrape, or harvest data; interfere with or disrupt the Service, its servers, or other users' access to it; or attempt to circumvent any content moderation, security, or access-control feature.
- We reserve the right to remove content, suspend, or terminate accounts that violate these Terms, at our sole discretion and without prior notice.
7. User Content and License
- "User Content" means any information, text, images, or other material you submit to the Service, including profile information, show and shop listings, photos, and messages.
- You retain ownership of your User Content. By submitting User Content, you grant Card Shows Nearby a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that content as necessary to operate and promote the Service (for example, displaying a submitted show listing publicly, or a profile photo on your public profile).
- You represent that you own or have the necessary rights to the User Content you submit, and that it does not infringe any third party's intellectual property or other rights.
8. Third-Party Sign-In
- You may sign in using a third-party account (such as Google). Your use of that third-party service is governed by that provider's own terms and privacy policy, and we are not responsible for the practices of third-party sign-in providers.
9. Intellectual Property
- The Service, including its design, text, graphics, logos, and underlying software (excluding User Content), is owned by Card Shows Nearby or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.
10. Copyright Complaints (DMCA)
- If you believe content on the Service infringes your copyright, please send a written notice to info@cardshowsnearby.com including: (a) a description of the copyrighted work you claim has been infringed; (b) a description and URL/location of the allegedly infringing material on the Service; (c) your contact information (name, address, phone number, email); (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
- We will investigate valid notices and may remove or disable access to allegedly infringing material at our discretion. Repeat infringers may have their accounts terminated.
11. Disclaimers
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
- We do not guarantee the accuracy, completeness, or timeliness of any listing, and we are not responsible for the conduct of any organizer, shop, vendor, or user, online or at any in-person event discovered through the Service.
12. Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARD SHOWS NEARBY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
- Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
- You agree to indemnify and hold harmless Card Shows Nearby and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: your use of the Service; your User Content; your violation of these Terms; or your violation of any third party's rights.
14. Termination
- You may stop using the Service and delete your account at any time from your Profile page.
- We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to the Service, other users, or third parties.
- Provisions that by their nature should survive termination (including Sections 9–13 and 16) will survive.
15. Changes to These Terms
- We may revise these Terms from time to time. If we make material changes, we will update the "Last updated" date below. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles, unless otherwise required by applicable law.
- Before filing a claim against Card Shows Nearby, you agree to first contact us at info@cardshowsnearby.com and attempt to resolve the dispute informally.
- Any dispute arising from these Terms or the Service that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to personal jurisdiction there.
17. Miscellaneous
- If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
- Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Card Shows Nearby regarding the Service.
- You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction.
